TERMS AND CONDITIONS:

Cayman Cigar Company (“Cayman Cigars,” “CCC Cayman LLC,” “we,” “us,” “site” or “our”). By using the Site, you agree to be bound by these Terms and Conditions (“Terms”).

RETURN POLICY:

We are committed to your total satisfaction. Our cigars ship via USPS in the United States from our temperature and humidity-controlled humidor in Tampa, Florida. If your cigars arrive damaged, snap and send a photo and we’ll make it right.

FDA WARNING:

This product contains nicotine. Nicotine is an addictive chemical. This product is intended for use by adults of legal smoking age and not by children, women who are pregnant or breastfeeding, or persons with or at risk of heart disease, high blood pressure, diabetes, or taking medicine for depression or asthma. If you have a demonstrated allergy or sensitivity to nicotine or any combination of inhalants, consult your physician before using this product. This product is sold purely for recreational purposes – it is not a smoking cessation product and has not been tested as such. Keep out of reach of children and pets. Store in a cool, dry place away from direct sunlight.

INTELLECTUAL PROPERTY:

The Site and its original content, features, and functionality are owned by Cayman Cigar Company and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

LICENSE TO USE THE SITE:

We grant you a non-exclusive, non-transferable, limited license to access and use the Site solely for your personal, non-commercial purposes. You may not reproduce, modify, distribute, display, or otherwise use any content on the Site for any purpose without our prior written consent.

DISCLAIMER OF WARRANTIES:

The Site is provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

LIMITATION OF LIABILITY:

In no event shall Cayman Cigar Company, its directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or any products or services purchased through the Site.

INDEMNIFICATION:

You agree to indemnify and hold Cayman Cigar Company harmless from and against any and all claims, damages, liabilities, and expenses arising out of or in connection with your use of the Site or any products or services purchased through the Site.

TERMINATION:

We may terminate or suspend access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

GOVERNING LAW:

These Terms shall be governed and construed in accordance with the laws of the Cayman Islands, without regard to its conflict of law provisions.

CHANGES TO THESE TERMS:

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice on the Site prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

INTERNATIONAL CUSTOMS AND/OR DUTIES:

All applicable duties or Customs fees are the responsibility of the customer. We suggest you contact your customs agency for further information. Cayman Cigar Company will not be liable for any order delays caused by customs issues. Cayman Cigar Company will not be liable for duties, tariffs, taxes, or other restrictions imposed by the destination country or state. Tobacco laws vary from one country to another and any VAT, taxes or customs fees will be paid by the customer upon receipt of shipment. Customers are responsible for understanding their own country’s tobacco policies, import laws and other regulations before placing their order.

BACKORDERED ITEMS:

Because all our cigars are handmade in small batches, we occasionally encounter short delays and out-of-stock (OOS) situations due to the nature of these products. In the unlikely event of an OOS situation, you will be notified immediately, and you will have the option of holding your order until items are back in stock. WE WILL NOT CHARGE YOUR CARD UNTIL ITEMS ARE IN STOCK FOR SHIPMENT.

P.O. BOXES, APO/FPO ADDRESSES, UNITED STATES TERRITORIES:

Shipments to P.O. Boxes, APO/FPO addresses and U.S. Territories will be via USPS. Upgraded or Priority Mail are not available.
